Who Can File Chapter 7?

The first part to determine your eligibility for Chapter 7 bankruptcy, is a process which is referred to as the “means test.” The “means test” is designed to determine whether you can afford to pay back your creditors. Individuals with high income will not qualify for a Chapter 7 bankruptcy. 

Chapter 7 eligibility is also determined by the value of your assets. State law provides certain protections for your home, vehicles, and personal property but sometimes if they are very valuable or have no liens against them, it can cause problems in a Chapter 7 case. 

Lastly, you are ineligible for a Chapter 7 if you have a recent Chapter 7 discharge.

 Non-Dischargeable Debts

Keep in mind that Chapter 7 bankruptcy may not discharge all debts. Certain debts that cannot be discharged include those related to alimony, child support, fraudulent debts, and student loans, as well as certain back taxes.
